By using the Services, you are agreeing to all of the Terms of Use, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Use.

1. Interpretation

Unless accepted by Tranquil Birth in writing no variation or modification of these terms and conditions will bind Tranquil Birth.
“Tranquil Birth” means Tranquil Birth Pty Ltd (ACN 666 202 455).
“Customer” “You” “Your” means the party engaging Tranquil Birth to provide the Services.
“Services” means the services provided by the Company to the Customer pursuant to this Website.

2. Our engagement

A contract to engage Tranquil Birth to provide the Services will exist upon written acceptance by Tranquil Birth of your order. An order may be made by the Customer on the Website, which is accepted by the Company in writing, will result in a legally binding contract between the Company and the Customer which incorporates these terms and conditions.

3. Payment

All orders must be paid for in full at the time of placing the order. Your credit card details will not be stored in our database and will be deleted upon receipt of confirmation by Tranquil Birth that payment has been authorised and received.

4. Refund of moneys

Any dispute regarding payment and refund of moneys shall be at Tranquil Birth’s sole discretion.

5. Cancellation policy

Cancellation of Your order within 2 working days of confirmation of Your order and prior to commencement of the Services will allow You to apply for a full refund. The full refund can be applied to the credit card used to purchase the Services, or the bank account used to pay for the Services by internet banking. Cancellation refunds will not be paid after 2 working days of confirmation of Your order or if the Services has commenced.

6. Provision of Services

Tranquil Birth will not be responsible for any delays in the delivery of the Services which are outside Tranquil Birth’s control. Tranquil Birth will use all reasonable endeavours to enable the Services to be provided within 1-3 working days after payment and the actual commencement date shall be as agreed between You and Tranquil Birth in writing. If the Services cannot commence for any reason or the commencement date is required to be varied, the Company will use all reasonable endeavours to contact you within 1-3 working days to negotiate a new commencement date.

7. Amendments to Terms of Use

Tranquil Birth reserves the right to amend these Terms of Use from time to time. Amendments will be effective immediately upon notification on this Website. Your continued use of the Website following such notification will represent an agreement by you to be bound by the terms and conditions as amended.

8. Website

Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.

This Website may contain links to other websites (Linked Sites), which are not operated by Tranquil Birth. Notwithstanding any other provision of these terms and conditions, non-performance by Tranquil Birth of any of its obligations under these terms and conditions will be excused, without liability for non-performance, during the time and to the extent that performance is prevented, wholly or substantially, by any event or circumstance (whether arising from natural causes, human agency or otherwise) that is beyond the reasonable control of Tranquil Birth, including strikes, lockouts or other labour disputes, riot, civil commotion, pandemic, fire, flood, drought, loss or delay at sea, breakdown or war (whether declared or not) (Force Majeure Event). Performance of any obligation affected by a Force Majeure Event will be resumed as soon as reasonably possible after the termination or abatement of the Force Majeure Event.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
